    I'm fairly sure that to accurately DNA test you need the parents. I think you are talking about the DNA tests they have now which can "apparently" tell you what breeds of dog your xbred dog is. Many people have had these done and then posted the results up on various forums and they appear to be a crock of you know what!! Wouldn't waste my money thats for sure. I also could not see it being able to be used in court.

    The Council don't need to prove its a pittyx as Teebs has stated it is chipped as one.

    The dog is going to be let out tomorrow

    Still have not talked to the owner, she just pmed me last night - so not sure what exactly happened.

    I have been in contact with her -is she a member here?

    I am sooo pissed off. The dog was due to be out on Wednesday, nope, they said he had to be desexed (WHY?? He is not a dangerous/restricted breed yet! he has to get his temp test)

    THEN, she went to get him yesterday, and no, she cant have him - They want a written letter from the Real Estate saying they can build the cage that is needed to house him - WTF? if he passes the temp test he wont need a ****ing cage, he has not been declared a dangerous/restricted breed yet - HOW CAN THEY GET AWAY WITH THIS?

    I am sooooo mad right now, it is a good thing they shut 30 mins ago or I would be down there on their door step

    Tybrax was banned from here even before I got a chance to say G'day to Chrissie.
    Such is life.


    She is still a member over on Dol I think.
    There has to be someone from NSW who is such a tireless BSL researcher as herself, but specifically about NSW legislation.
    The only person I can think of is someone whose nic was Ducatibruce who posted on the edba before it wa shut down, I think he heads Pet rescue now? Its a Pet somthing or other. I'll try and find out.

    Thanks, i got into contact with someone on the EDBA who isn ow helping out!

    That sucks about Tybrax she is a great person to have on a forum, knows so much about BSL, why was she banned?

    If you have a browse of the NSW Companion Animals Act you will find some of what you're looking for. Local Governments may have additional regulations as well. But the ACT defines a restricted breed as:

    (a) American pit bull terrier or pit bull terrier,
    (b) Japanese tosa,
    (c) dogo Argentino,
    (d) fila Brasileiro,
    (d1) any other dog of a breed, kind or description whose importation into Australia is prohibited by or under the Customs Act 1901 of the Commonwealth,
    (e) any dog declared by an authorised officer of a council under Division 6 of this Part to be a restricted dog,
    (f) any other dog of a breed, kind or description prescribed by the regulations for the purposes of this section.


    The worry there is section (e) which appears to be giving Councils authority to decide whether a dog is one of those breeds. A dog that is DNA tested would no doubt have a better chance of beating a Council Officer's decision about it's breed. I don't know how far DNA test results have been tested in Court though.

    It's a very messy situation to be in indeed. I'm sorry for your friend's problems.

    The ACT does state that failing to comply with requirements for keeping a restricted breeds carries a maximum penalty of 150 penalty units. Which is $16 500. Penalties like this are determined by a Court though, and are not able to be dished out on infringement notices.

    Banned because her and Choppa got into it as usual!!

    Damn

    Ok, i went to council today

    Turns out this girl is in the wrong, she did get a NOI, and never followed through. Council guy told me she can house him in her garage if they get the ok to build a cage within a month - if she then wants to get a temp test and he passes, council will remove his restricted status. If he fails, he will have to be houses according to law

    I asked was there any way we could arrange a Temp Test, pick him up from the pound that morning, get the TT done, if he passes he can go home, if fails, the owner is happy to take him back to pound and build cage.
    Council guy is looking into it for us

    This guy has been great, the rangers told him to not be stupid and justPTS the dog, but this guy said they need to give us a chance and will call us tomorrow to let us know where we stand on getting a TT done ASAP and then not have to worry about the cage if he passes it

    ARGH!!!

    Well I hope the poor dog passes then, much easier if he does.
    I know the laws suck but it's up to the owner to follow thru otherwise it's the poor dog who gets pts!!

    Yep, she admits she is wrong, and didnt even realise it till i got hold of the paper work and read it!
