    I think part of the trouble is with the legislation itself.

    The State government said they were going to come down hard on any dog mis-identified as SBT when in fact it was something that met their visual criteria for APBT or APBT x. So it may be that some people decided to be honest about their dog being an APBT ie restricted breed in the hope that they could keep it but didn't understand the different requirements and fees for keeping a restricted breed. I have read a lot of complaints to this effect. However - it's hard to prove a dog is an APBT. The law sort of changed that to say that the ranger could just declare it and then it's up to the owners to fight the VCAT.

    So a grumpy ranger could declare a chihuahua x to be a APBTx and the dog would be locked up and have to go through VCAT. Years later... the owners might get their dog back.

    Default Ballarat APBT... the real story

    The fact behind this issue are pretty much captured the posts here ... except that the owner did not try to register by phone but in person and did offer to come back within the amnesty period. She was told by council that she could return the following day and she beleived them. She did get there late becuase she works shift work and was sleeping but had time to return prior to closing.

    The owner filling in the registration form is what "tipped" council off to the existance of the dog... so council refuse to rely on the registration form for the purposes of registration but will rely on it for the restricted breed declaration.

    Lets see what VCAT makes of all this

    The legislation is a discarace and most bull breeds and some others without papers could fall foul of it. In this case it was the actions of the council rather than the legislation that bit the owners

    I just found this club whilst trawling for further information on BSL and the new amendments to the dog act and am dismayed to find so many negative comments blaming the owners of the pit bulls in Ballarat. Councils, in my opinion, have no idea how to enforce these laws and are causing responsible dog owners a great deal of heartache and distress by acting in manners that are inappropriate and unhelpful. I suggest all you unpleasant folk who have made these unpleasant statements educate yourselves as to how BSL has failed and been repealed in some other countries due to it being viewed as a failure and also to the other cases being brought to VCAT and, mostly, how YOU would feel if it was YOUR dog/s.

    Huh? Have we read the same thread? The majority of us here are against BSL, so not sure who your comment is directed to at all.

    A lot of newbies to forums, don't know to read the whole thread before posting. Just check the join date and throw bag of salt over shoulder accordingly.

    But it did prompt me to find out what actually happened after the last post. And turns out the case was deferred, so their dog will be in custody for another few months.

    Well,the first dogs to have a hearing in VCAT have been the Cobram dogs- Bear and Kooda, and VCAT have made NO decision, so the case goes on. In the meantime, dogs are being destroyed and imprisoned due to new amendments that councils don't understand themselves. it is time that people who wish their dogs to be free from harsh and unreasonable laws all stand together to fight council harassment and i would like all of those people whom have been intimidated by council regulations on dogs to inbox me as I am fighting these new laws politically and require both support and facts!

    I may be a newbie to this site, but there WERE some comments about how the Ballarat couple should have registered their pitty prior to the amnesty that seemed to be blaming the owners in my opinion. If this site is about sharing information about dogs, then I have a lot to offer as my own dogs have been impounded now for several months under the new amendments to the Domestic Animals Act and I can only see the situation becoming worse under these new laws and I am presently engaged in a legal battle about my own dogs and the council regulations where I live.
