    I think the people writing in these legislations are fruitloops lol, they say they are authorised (police et al),to be in any premisis to determin number of dogs, registration, etc, but if they have a reason to believe an actual offence has been commited they arent allowed to enter the premises without warrant? wth....

    73. Entering land


    (1) An authorised person who has reason to believe that the owner or person in charge of a dog has committed an offence against this Act may –
    (a) enter onto land owned or occupied by that owner or person, but not any dwelling on that land; and
    (b) search for and seize any dog on that land.
    (2) An authorised person may apply to a magistrate for a warrant to enter any dwelling on that land to enforce any provision of this Act.
    (3) A magistrate, by warrant, may empower an authorised person and any other person named in the warrant to enter a dwelling by force if –
    (a) the dwelling is not occupied; or
    (b) entry into the dwelling has been refused or is likely to be refused.
    (4) A warrant continues in force until the purpose for which it was granted is satisfied.
    (5) Division 4 of Part 3 applies in respect of a dog seized under this section as if it were a dog at large.
    (6) If a dog is seized under this section, the relevant general manager must give the owner of the dog written notice stating –
    (a) the offence against this Act that it is alleged has been committed; and
    (b) any steps that the general manager requires to be undertaken before the dog is returned, to prevent the commission of the same or another offence against this Act; and
    (c) that the dog may be disposed of or destroyed if not claimed within 5 days after the date of the notice.

    This is one of those parts of any of the nations regs that really irritate me.
    Because when you get right down to the nitty gritty , the ONLY two lots of people 'allowed' to enter your premises for whatever reason,is a Bailiff/Sheriff or the Police,and the Police may only do so with a warrant handed down from a magistrate.

    Why they insist putting such wording is beyond me .

    Hi,
    I had a look under the animal managment legistlation for QLD for you and I have found that if you can get a certificate signed by a vet surgeon stating or to the effect that your dog is of a paticular breed(am staff) they cannot seize your dog for being a "pit".. although they can seize if they believe the dog is menacing/dangerous < this applies to any breed!! FYI- This is the website for your reference ( you will find the info I gave you on page 42 (63a).

    All good. I know Qld legislation back to front these days. Thanks though.

    State Legislation states that a crossbreed is not of a breed. Ie: If you have a Pitbull X then your dog is fine, and as APBT are not a recognised breed here then all Pitts are Pitt x's so they are really all safe. The biggest issue here in Qld is that the Council's have harsher laws then the State but the Councils are less inclined to seize dogs these days because of all the court cases we have had.

    Im in logan(underwood) as well and now im concerned about doing toffee's rego(which i havent done yet). she is a mastiff x amstaff. Should i be???? Could i say she is a mastiff x and forget to mention the amstaff side??? The papers i got from the pet shop decribes her as mastiff x.

    Lea no need to worry. As stated earlier in the thread things here in qld are not an issue. No dogs hve been seized of late and councils are wary of doing anything, there have been too many court cases that have not gone in their favour.

    If your dog is a Mastiff x and that is what the info from the store says then register her as a Mastiff x.
